Welcome to the Textbook Media Press ("Company", "we", "our", "us") platform. As a publisher or user of our platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.
2.1. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.1. Publishers are solely responsible for all content they upload, publish, or distribute through the Platform.
3.2. Publishers warrant that they own or have obtained all necessary rights, licenses, and permissions to publish and distribute their content through our Platform.
3.3. Publishers agree that their content does not violate any copyright, trademark, privacy rights, or other intellectual property rights, and complies with all applicable laws and regulations.
4.1. Publishers are responsible for ensuring that their use of the Platform complies with all applicable privacy laws and regulations, including but not limited to FERPA, COPPA, and GDPR where applicable.
4.2. We implement industry-standard security measures to protect content and user data. However, publishers remain responsible for the security and privacy implications of the content they publish and agree to indemnify us from any claims arising from their content or distribution practices.
5.1. The Platform retains published content and associated data while publishers maintain an active subscription. After subscription termination, content will be retained for a grace period as specified in your publisher agreement, after which it will be permanently deleted from our systems.
5.2. Publishers are responsible for maintaining backup copies of their content and data. We recommend regular exports of content and analytics data for your records.
6.1. Publishers agree to use the Platform in a manner consistent with ethical publishing practices and industry standards.
6.2. Content published must comply with all applicable educational standards and must not contain illegal, defamatory, or harmful material.
6.3. Publishers are responsible for ensuring their content meets appropriate educational standards and accessibility requirements.
7.1. Publishers retain all intellectual property rights to their published content. By using our Platform, publishers grant us a limited license to host, display, and distribute their content as necessary to provide our services.
7.2. We do not claim ownership of publisher content and will not sell or distribute your content beyond the scope of services agreed upon in your publisher agreement.
Users agree not to:
9.1. The Platform is provided "as is" without warranties beyond those explicitly stated in publisher agreements. We strive to maintain high service quality but do not guarantee uninterrupted or error-free operation.
9.2. We shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to lost revenue or lost content.
9.3. Textbook Media Press provides a technology platform and does not review, endorse, or take responsibility for the content published by publishers. Publishers are solely responsible for their content.
10.1. Publishers are responsible for ensuring the accuracy, completeness, and quality of their published content.
10.2. We do not verify or validate the educational content published on our Platform and make no representations regarding its accuracy or suitability for any particular purpose.
We may modify these Terms or the Service at any time. Continued use after changes constitutes acceptance of the new Terms.
We reserve the right to terminate or suspend accounts for violation of these Terms, publication of prohibited content, or other activities that harm the Platform or other users. We will provide notice when reasonably possible, except in cases of severe violations or legal requirements.
13.1. Publishers acknowledge that once content is distributed through the Platform, they are responsible for how that content is used by end users in accordance with the terms they set. Textbook Media Pressis not liable for unauthorized distribution or misuse of content by end users or third parties.
These Terms are governed by the laws of the State of Minnesota, United States of America. Any disputes will be subject to the exclusive jurisdiction of the courts in the State of Minnesota, United States of America.
